Agreement to these Terms
These Terms of Use and Marketplace Terms ("Terms") apply to your access to and use of myhostly.co and the domain marketplace services operated by FYNORYXA LIMITED.
By using myhostly.co, submitting a purchase request, making an offer, submitting a domain for review, or communicating with us about a transaction, you agree to these Terms. If you do not agree to these Terms, do not use myhostly.co.
About us
myhostly.co is operated by FYNORYXA LIMITED, a private limited company registered in England and Wales with company number 17235157 and registered office at 72 Nile Street, London, England, N1 7SR. Contact: [email protected].
Marketplace role
myhostly.co is a domain marketplace. We list reviewed domain names and digital brand assets and help coordinate transactions between buyers and vendors.
Unless expressly agreed in writing:
- we are not a domain registrar;
- we are not an escrow provider;
- we are not a payment processor;
- we are not a legal, tax, trademark or investment adviser;
- we do not guarantee that a domain will be suitable for any particular business, brand, trademark, regulated activity or jurisdiction.
Domain ownership transfers are completed through standard registrar-supported workflows, such as registrar push, authorisation code transfer, account-level ownership update or other registrar-supported methods.
Eligibility
You must be at least 18 years old and have legal capacity to use myhostly.co. If you use the website on behalf of a company or organisation, you confirm that you have authority to bind that organisation.
Listings
We aim to provide clear details about domain listings, including category, description, transfer method and asking price where available.
Listings may change, be withdrawn, become unavailable or contain errors. A listing does not create a binding offer by us to sell a domain. A transaction becomes binding only when we confirm the transaction terms and payment/transfer process in writing.
Purchase requests and offers
You may submit a purchase request or offer through the website or another approved communication channel. By submitting a request or offer, you confirm that:
- the information you provide is accurate and complete;
- you are acting lawfully and in good faith;
- you have authority to proceed with the transaction;
- you will complete reasonable verification steps if requested;
- you understand that domain availability and transfer readiness must be confirmed.
We may accept, reject, decline to process or request more information about any request or offer at our discretion.
Prices and fees
Prices may be displayed in EUR or another stated currency. Unless stated otherwise, the listed price is the buyer-facing price for the domain listing.
We do not add hidden marketplace checkout fees to the buyer-facing listed price. However, third-party charges may apply, such as payment provider fees, currency conversion fees, bank fees, registrar transfer fees, renewal fees, taxes or VAT where applicable.
For vendor transactions, we may deduct a marketplace service fee from the sale amount according to terms agreed with the vendor in advance.
Tax treatment, VAT and reporting obligations depend on the parties, jurisdictions and transaction structure. Buyers and vendors are responsible for obtaining their own tax advice. VAT or tax details, where applicable, will be shown at the relevant stage of a transaction.
Payments
Payments may be completed through approved third-party payment providers using external hosted payment pages. We do not collect or store full card details directly on myhostly.co.
Payment instructions must be followed carefully. Do not send payment to any account, wallet or person unless the payment link or instructions have been confirmed through an official MyHostly communication channel.
We may delay or cancel a transaction if payment is not confirmed, if fraud checks fail, if the domain is no longer available, or if transfer readiness cannot be verified.
Domain transfers
Domain transfers are subject to registrar rules, registry rules, ICANN policies where applicable, transfer locks, expiry dates, account verification, payment confirmation, buyer and vendor cooperation, and technical or compliance checks.
Estimated transfer times are not guaranteed. Delays may occur due to registrar procedures, transfer locks, missing information, incorrect account details, compliance checks, registry restrictions or third-party service issues.
The buyer is responsible for maintaining accurate registrar account details and for accepting or completing transfer steps promptly. The vendor is responsible for maintaining the domain in good standing until transfer is completed.
Ownership and risk
Unless agreed otherwise in writing, domain ownership is treated as transferred when the relevant registrar or registry confirms that control of the domain has moved to the buyer or the buyer's nominated account.
After transfer completion, the buyer is responsible for renewal fees, registrar account security, DNS configuration, website use, email configuration, trademark clearance, brand use, compliance and all future operation of the domain.
Vendor obligations
If you submit a domain for review or sale, you confirm that:
- you own or control the domain;
- you have authority to sell or transfer the domain;
- the domain is not stolen, disputed, subject to unresolved legal claims or knowingly infringing third-party rights;
- you will disclose any known restrictions, transfer locks, premium renewal fees, registrar limitations or disputes;
- you will cooperate promptly with transfer steps;
- your submission information is accurate and not misleading.
We may reject, remove or suspend any listing at our discretion.
Buyer due diligence
Buyers are responsible for their own due diligence before purchasing a domain. This includes checking:
- trademark and brand risks;
- domain history and reputation;
- search engine or email reputation;
- regulatory suitability;
- renewal costs;
- spelling, meaning and local language implications;
- whether the domain fits the buyer's intended use.
We do not guarantee that a domain will be free from third-party claims or suitable for a particular commercial purpose.
Prohibited conduct
You must not:
- use the website for unlawful, fraudulent, abusive or misleading activity;
- submit false, stolen or unauthorised domain listings;
- impersonate another person or organisation;
- interfere with website security or availability;
- scrape or copy listings at scale without permission;
- bypass payment or transfer procedures;
- use domains purchased through the marketplace for malware, phishing, spam, counterfeit goods, illegal content or rights infringement;
- attempt to manipulate offers, reviews, availability or transfer status.
Intellectual property
The myhostly.co website, layout, text, branding, listing format, software and content are owned by or licensed to FYNORYXA LIMITED unless otherwise stated.
You may use the website only for legitimate browsing, purchase, offer and vendor-submission purposes. You may not copy, reproduce, modify, scrape, resell or exploit website content without our written permission, except as permitted by law.
Domain names listed on the marketplace may include words, strings or marks that are not owned by us. A domain listing does not grant trademark, business name or other intellectual property rights beyond the domain registration rights that are actually transferred.
Third-party services
myhostly.co may link to or integrate third-party services, including registrars, payment providers, analytics providers and communication tools. We are not responsible for third-party websites, terms, privacy notices, outages, fees or decisions.
Disclaimers
The website and marketplace are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee that:
- the website will be uninterrupted or error-free;
- any listing will remain available;
- a domain will achieve any business, traffic, search, branding or resale outcome;
- a domain will be free from all legal, trademark, reputation or technical risks;
- third-party registrars, payment providers or vendors will act without delay or error.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Limitation of liability
To the maximum extent permitted by law, FYNORYXA LIMITED will not be liable for indirect, consequential, special, punitive or exemplary losses, loss of profits, loss of revenue, loss of goodwill, loss of business opportunity, loss of data, search ranking loss, email deliverability loss or domain reputation loss.
Our total liability arising out of or in connection with a transaction is limited to the marketplace fee actually received by us for that transaction, unless a different mandatory legal rule applies.
Suspension and termination
We may suspend access, reject requests, remove listings, cancel pending transactions or stop providing services where we reasonably believe there has been fraud, misuse, breach of these Terms, legal risk, payment failure, transfer issue or marketplace integrity concern.
Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on myhostly.co. Continued use of the website after changes take effect means you accept the updated Terms.
Governing law and courts
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer protection laws provide otherwise.
